Terms of use

General terms for connecting to the Sigma Monitoring Alarm Receiving Centre.

Draft pending legal review. These terms have been rewritten to be easy to read. In all cases the text of the signed contract applies.

The service

  1. SIGMA Monitoring Ε.Π.Ε. (“the Company”) operates an Alarm Receiving Centre at its premises, running 24 hours a day with modern equipment and trained operators. It receives subscribers' signals and notifies the competent authorities and the authorised persons the subscriber has named.
  2. The subscriber chose to connect with the Company, considers its specifications technically and operationally sound and accepts all the terms.
  3. The Company's obligation is to inform, by telephone and as soon as possible, the competent authorities and/or authorised persons when it receives a burglary, robbery, duress, fire or medical signal. If it does not receive such a signal for any reason (e.g. line fault or sabotage), it bears no liability or obligation to act.
  4. The Company gives the subscriber and authorised persons information only about the signals it has received. Information about the state of the system or the site is outside the agreed services, and the operator's answer does not bind the Company.

Communication between alarm and centre

  1. Signals are transmitted over the subscriber's communication channel (phone line, internet or mobile), for which the subscriber is solely responsible. A channel fault may cause the alarm to call repeatedly without the signal reaching the centre, as well as excess phone charges, for which the subscriber is liable.
  2. The Company is not liable for sabotage or malfunction of the telephone provider's network that interrupts communication between the alarm and the centre.
  3. If a burglary is combined with sabotage (cutting the line or jamming the backup mobile communicator), the centre receives no signal and the Company is not liable for the incident.
  4. The GPRS service includes 25 MB of data per month. After that, €0.13 per MB is charged.

Logging and notifications

  1. All signals are logged. Only the Company's electronic records, kept for six (6) months while the contract is active, serve as proof.
  2. The Company is not liable if authorised persons do not answer. The Company's call log serves as proof of the call.
  3. The order in which persons are notified does not bind the Company. The obligation is fulfilled when one of them answers.
  4. Changes to authorised persons must be notified in writing.

Subscriber obligations

  1. The subscriber follows the centre's instructions and is solely responsible for safeguarding the secret identification code.
  2. In case of a false alarm caused by operating error, the subscriber informs the Company immediately and gives the identification code the operator asks for.
  3. A condition of the contract is full coverage of the site by a modern alarm system. The system and the installer are chosen by the subscriber, who is solely responsible for its correct operation.
  4. The system is serviced at least once a year by the installer, at the subscriber's expense; the subscriber sends the Company a maintenance certificate signed by the installer.
  5. In case of a fault, the subscriber notifies the Company and the installer and repairs it immediately, at their own responsibility and expense. Any change or addition to the system must be notified in good time and in writing.

Liability and compensation

  1. The contract is not an insurance policy and does not guarantee compensation for damage to property or bodily injury. If the subscriber wants insurance, they ask the insurer for written confirmation that the system meets its requirements.
  2. The Company is liable for damage only if it received signals requiring immediate notification and, through gross negligence of its staff, the authorities and persons were not notified. Compensation shall in no case exceed €5,000.00, and the subscriber waives any claim beyond this amount, as well as any other interim measure against the Company.
  3. There is no obligation to compensate when: a) the system had not been put into operation, b) it was operating with zones closed or bypassed, c) it does not send arming and disarming signals, d) the communication line is faulty or cut.
  4. If the subscriber believes they suffered damage due to the Company's negligence, they notify the Company and the installer in writing immediately and within 48 hours at the latest.
  5. The Company is not liable for force majeure (e.g. earthquake, flood, fire, lightning, terrorist act) or if the authorities revoke its licences or prohibit the operation of the centre.

Term, payment, expiry

  1. Services are prepaid and provided for the period stated on the invoice.
  2. The contract renews automatically when the subscription is paid.
  3. If payment is more than 30 days late after expiry, the Company may terminate the contract and disconnect the service. From then on no signals are received and the Company is released from all liability.
  4. The Company's liability begins once it receives the signed contract.
  5. Either party may terminate the contract at any time if any term is breached.

Personal data and general terms

  1. The subscriber consents to the processing of their data and of the persons they name, for performing the contract, obligations to the authorities and the Company's operational needs, in accordance with the GDPR (EU) 2016/679. See the privacy policy.
  2. The subscriber has been informed of the centre's actions for each signal, through the connection application and the leaflet “Actions of the Alarm Receiving Centre”.
  3. No other oral or written agreement applies. Any amendment must be made in writing. The contract supersedes any previous agreement. The courts of Athens have jurisdiction over any dispute.
